HomeDash Terms and Conditions

1. About these Terms

These Terms and Conditions (the Terms) govern your access to and use of the HomeDash Android application and its related services (together, HomeDash or the Service).

HomeDash is provided by Derek Markell (we, us, or our) and helps households organize shared information such as household members, groceries, tasks, and events.

By creating a HomeDash account, accepting these Terms when they are presented, or using HomeDash after having an opportunity to review them, you agree to these Terms. If you do not agree, do not use HomeDash.

Our Privacy Policy explains how HomeDash handles personal information. Nothing in these Terms limits a right or remedy that cannot legally be limited or waived.

2. Eligibility

HomeDash is intended for adults managing a household. You may create an account only if you can legally agree to these Terms. Otherwise, a parent or legal guardian must create and supervise the account, accept these Terms, and take responsibility for its use.

HomeDash is not directed to children. Only add a child's information if you are their parent or guardian, or otherwise have authority to do so.

3. Your Account and Household

HomeDash requires Sign in with Google. You are responsible for using an account you are authorized to use, keeping your Google account and device secure, and activity performed through your signed-in HomeDash account. Contact us if you believe someone has accessed your account or household without authorization.

One HomeDash account currently owns and controls one household. Adding someone as a household member does not create a HomeDash account for that person or give them access to the Service.

4. Shared Tablet Use

HomeDash is designed for use on a shared household tablet. You are responsible for who has physical access to your device and what information you choose to display.

5. Household Content

You retain any rights you have in information you add to HomeDash (Household Content). You give us permission to store, process, transmit, and display it only as needed to operate and secure HomeDash, comply with law, and enforce these Terms. You are responsible for your Household Content and must have the right or authority to provide it.

6. Acceptable Use

You must not use HomeDash to:

  • break the law, violate another person's rights, or store unlawful, abusive, or infringing content;
  • impersonate someone or access another account or household without authorization;
  • introduce malware or interfere with HomeDash's operation, security, or access controls;
  • scrape, reverse engineer, or use automated access except where we or applicable law permit it; or
  • resell or commercially exploit the Service without our written permission.

We may investigate suspected misuse and take reasonable steps to protect HomeDash, its users, and others.

7. Licence and Ownership

Subject to these Terms and applicable app-store terms, we give you a non-exclusive, worldwide, personal licence to install and use HomeDash for non-commercial household purposes. Copies obtained through Google Play are also subject to Google's applicable terms, which control if they conflict with these Terms.

HomeDash, including its software, design, branding, and documentation, belongs to us or our licensors. No ownership rights are transferred to you.

8. Third-Party Services and Availability

HomeDash depends on services provided by Google, including Google sign-in, Google Play, and Firebase. Those services have their own terms and may affect whether HomeDash is available or able to synchronize information.

We may change, suspend, or discontinue features. When practical, we will give notice before a change that materially reduces the Service.

9. Fees

HomeDash is currently provided without charge. We may introduce optional paid features or subscriptions in the future. If we do, we will clearly disclose the applicable pricing and terms before you are charged.

10. Important Limitations

HomeDash is a household-organization tool, not an emergency or safety service. Do not rely on it as the only source for time-sensitive or safety-critical information.

11. Ending or Suspending Use

You may stop using HomeDash at any time. Signing out does not delete your data. You may delete your account as described in the Privacy Policy; deleting the owner account deletes its household and active Household Content and normally cannot be undone.

We may suspend or end access to the hosted Service if you materially violate these Terms, create a security or legal risk, if a provider or the law requires it, or if we discontinue HomeDash. When practical, we will provide notice first.

12. Disclaimers and Liability

To the maximum extent permitted by law, HomeDash is provided as is and as available. We do not promise that information will always be complete, current, or recoverable, and we disclaim implied warranties and conditions to the extent the law allows.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of use, data, opportunity, or profits arising from HomeDash.

To the maximum extent permitted by law, our total liability relating to HomeDash will not exceed the greater of the amount you paid us during the 12 months before the claim arose and CAD $50.

Nothing in these Terms excludes or limits liability, warranties, conditions, rights, or remedies that applicable law says cannot be excluded or limited.

13. Changes to these Terms

We may update these Terms when HomeDash, our providers, or legal requirements change. We will update the effective date and provide any notice required by law. Material changes will not apply retroactively unless required by law or you agree.

14. Governing Law and Disputes

These Terms are governed by Ontario law and the federal laws of Canada applicable there. Ontario courts have non-exclusive jurisdiction, but this does not prevent you from using another forum or remedy available under applicable law.

Before starting a formal proceeding, you and we will make a reasonable effort to resolve the issue by contacting the other party. This does not require arbitration or limit any legal right.

15. General

These Terms and any additional terms presented for a particular feature form the entire agreement concerning HomeDash. If any part is unenforceable, the remaining parts will continue in effect. A failure to enforce a provision is not a waiver of it.

You may not transfer your account or these Terms without our permission. We may transfer these Terms as part of a reorganization, merger, acquisition, or transfer of HomeDash, subject to applicable law and required notice.
